Terms and Conditions

1. Introduction and Acceptance of the Terms

Welcome to “Marefati.”

These Terms and Conditions (“Terms”) govern your access to and use of the Marefati application and website, as well as the educational services and features available through them. The application, website, and related services are collectively referred to in these Terms as the “Platform” or the “Services.”

Marefati enables a Parent or Guardian to book and purchase live educational Classes for a Student and to access the related educational features and Services, as described in these Terms.

For the purposes of these Terms, “Parent or Guardian” means the Student’s parent or legal guardian who creates the account, purchases the Service, or consents to its use on behalf of the Student. The Parent or Guardian is referred to in these Terms as “you” and through related terms such as “your account,” “your use,” and “your responsibility.” “Student” means the child for whom a Platform membership is created or who receives educational Services through the Platform.

By creating an account, purchasing a Service, accessing the Platform, or using it, you confirm that you have read, understood, and agreed to be bound by these Terms. You also confirm that you have the legal authority to accept these Terms on behalf of the Student and that you are responsible for supervising the Student’s use of the Platform and explaining the applicable rules to the Student in a manner appropriate to the Student’s age and ability to understand.

If you do not agree to these Terms, you must not create an account, purchase the Services, or use the Platform.

These Terms must be read together with Marefati’s Privacy Policy, which explains how Personal Information is collected, used, and protected, including information relating to the Parent or Guardian and the Student.

Marefati may amend these Terms when necessary. When material changes are made, we will indicate the date of the latest update. You are responsible for regularly reviewing the latest version of these Terms of Service, available at https://marefati.ae/terms. Your continued use of the Platform after the changes take effect constitutes your acceptance of the amended Terms.

You acknowledge and agree that:

2. Access to and Use of the Marefati Platform

Registration and Eligibility Obligations

An account may be created and Services may be purchased through Marefati only by a Parent or Guardian who has reached the legal age and has the legal capacity required to accept these Terms and enter into a binding contract.

When creating an account for a Student, you acknowledge and agree that:

  1. You are the Student’s parent or legal guardian, or you otherwise have the legal authority required to create the account and accept these Terms on the Student’s behalf.
  2. You are responsible for providing accurate, complete, and current information during registration, including information relating to the Parent or Guardian and the Student, and for updating that information when it changes.
  3. The Student does not enter into an independent contract with Marefati and may not make purchases, renew a Billing Cycle, modify a booking, or take any financial action without your approval, subject to the controls available on the Platform.
  4. You consent on the Student’s behalf to the Student’s use of the Platform and the Services, and you are responsible for appropriately supervising that use and explaining the relevant rules and instructions in a manner appropriate to the Student’s age and ability to understand.
  5. You will ensure that the Student uses the Platform only for educational purposes and the Services intended for the Student and that the Student complies with the conduct and safety rules and any other instructions that apply to use of the Service.
  6. The account and login credentials may not be made available to anyone other than the Parent or Guardian and the Student associated with the account. The account may not be used by another Student or on behalf of a third party unless Marefati expressly approves such use.
  7. More than one account may not be created for the same Student without a legitimate reason or Marefati’s approval. Marefati may disable duplicate accounts or accounts created to circumvent Platform rules, Promotions, or restrictions imposed on an earlier account.
  8. You may not create a new account or use another account to circumvent the suspension, restriction, or termination of your account.
  9. Marefati may request reasonable information or documents to verify the identity of the Parent or Guardian or the Student, or the accuracy of the information provided, where necessary to protect the account, protect the Student’s safety, prevent fraud, or comply with legal requirements.
  10. Certain Services or features may be subject to additional eligibility requirements or consents, which will be displayed when the relevant Service is used.

If the information provided is inaccurate, or if an account is created or used in violation of these Terms, Marefati may restrict, suspend, or terminate the account, subject to any existing rights relating to paid Services and any requirements imposed by law.

Account, Login Credentials, and Security

You are responsible for maintaining the confidentiality of the login credentials associated with your account, including your password and parental personal identification number (“PIN”), and for taking reasonable measures to prevent unauthorized access to the account or the device used to access the Platform.

You acknowledge and agree that:

  1. You must provide accurate registration information and keep the email address, phone number, and other contact information associated with the account up to date.
  2. You may not share your password or parental PIN with any unauthorized person or allow the Student or any other person to use features reserved for the Parent or Guardian without your supervision and approval.
  3. The Student’s account may be used only by the Student associated with it and the Student’s Parent or Guardian. It may not be lent, transferred, sold, or made available to another Student or any third party.
  4. You are responsible for activities and actions carried out through the account using the correct login credentials to the extent that they result from your allowing another person to use the account or from your failure to protect the login credentials or device.
  5. You must notify Marefati immediately if you know or suspect that login credentials have been lost, the account has been used without authorization, the parental PIN has been disclosed, the device used to access the Platform has been lost, or any other account-related security breach has occurred.
  6. You must change the password or parental PIN whenever there is a reasonable basis to believe that either has become known to an unauthorized person.
  7. Marefati may temporarily suspend access to the account, require the password or parental PIN to be reset, or apply additional verification measures if Marefati reasonably suspects unauthorized use, attempted fraud, a threat to account security, or a risk to the Student’s safety.
  8. You may not attempt to access another user’s account, bypass parental safeguards or verification measures, or use login credentials that do not belong to you.
  9. You must ensure that the device used to access the Platform is protected by appropriate measures, such as a device passcode, and that the account is not left accessible to unauthorized persons.

Marefati will not be responsible for losses or damage resulting directly from sharing login credentials or the parental PIN, making the account available to an unauthorized person, or failing to notify us of suspected misuse within a reasonable time. This does not limit Marefati’s responsibility for a security failure or negligence attributable to Marefati, or for any liability that cannot be excluded by law.

General Practices Regarding Use and Storage

You acknowledge that Marefati may establish general practices and limits relating to use of the Service, including, without limitation:

You agree that Marefati will not be responsible or liable for the deletion of, or failure to store, any data or other content saved or uploaded through the Service.

You acknowledge that Marefati reserves the right to terminate accounts that remain inactive for an extended period.

Modifications to the Service

Marefati continuously develops new features to improve the Services and your experience.

As part of this ongoing improvement, Marefati may:

If a change materially affects a paid Service during an active Booking Cycle, Marefati will take an appropriate measure, such as providing an alternative, rearranging the booking, or refunding the amount due, depending on the circumstances.

3. Payment, Cancellation, and Refunds

Payment

  1. Before completing payment, you will be shown the Student’s proposed schedule, including the subjects, days, times, assigned Teachers, the start and end dates of the Billing Cycle, and the total amount payable.
  2. Payment is made for one or more appointments with Independent Teachers that repeat weekly throughout the specified Billing Cycle, and not for the purchase of each Class separately.
  3. Prices are stated in United Arab Emirates dirhams. The final price and any applicable taxes or fees will be displayed before payment is confirmed. The final price recorded in the purchase request, payment confirmation, and transaction record will be the applicable price for that Billing Cycle.
  4. Marefati manages the electronic collection of payments and arranges their settlement in accordance with the arrangements approved between Marefati, the Independent Teachers, and payment service providers.
  5. You authorize Marefati and its approved payment service providers to charge the total displayed amount to the payment method you provide when confirming the purchase.
  6. Providing payment details or initiating payment does not confirm the booking. The schedule and Billing Cycle become confirmed only after payment succeeds and a booking confirmation appears through the Platform.
  7. If payment fails or is not completed, the Billing Cycle will not begin and the schedule will not be confirmed. If the temporary hold on the appointments expires before payment is completed, you may be required to search again for available appointments or Teachers.
  8. If an amount is charged but the booking appears not to have been confirmed, or if the amount is charged more than once, you must notify Marefati through its approved contact channels and provide the information required to verify and resolve the transaction.
  9. A Billing Cycle does not renew automatically, and no amount for a new Billing Cycle will be charged unless you confirm the renewal and complete a new payment. Teacher or time-slot availability may change if renewal is not completed within the available period.
  10. Marefati may use third-party payment service providers to process payments. Use of a payment method is also subject to the terms of the relevant bank or payment provider. Marefati does not store complete card details where they are processed directly by the payment provider.
  11. After payment succeeds, Marefati will provide you with a transaction record containing the amount paid, a description of the Service, the Billing Cycle, and other relevant details.
  12. You are responsible for ensuring that payment information is accurate and that you have the authority required to use the payment method provided. Marefati may reject or suspend a transaction that it reasonably suspects is unauthorized or fraudulent until the transaction is verified.
  13. Cancellations, booking modifications, and refunds are subject to the provisions set out in the relevant sections of these Terms.

Cancellation

  1. Once payment succeeds and the schedule is confirmed, the booking remains effective throughout the specified Billing Cycle, and you may not unilaterally cancel or end the Billing Cycle early after confirmation.
  2. The Billing Cycle must continue until its stated end date. The Student’s discontinuation of Platform use, failure to attend Classes, or unwillingness to continue studying does not cancel or end the Billing Cycle early.
  3. During a Billing Cycle, you may not cancel one recurring weekly appointment or one booked subject while keeping the rest of the schedule active. All confirmed appointments remain in effect until the end of the Billing Cycle, subject to the booking-modification and Teacher-change provisions in these Terms.
  4. Deleting the application, ceasing to log in, turning off the device, or contacting the Teacher directly does not constitute a valid cancellation request.
  5. A Billing Cycle does not renew automatically. If you do not wish to continue after the current Billing Cycle ends, you need only refrain from purchasing a new Billing Cycle or confirming renewal. The booked Services will remain available until the current Billing Cycle ends.
  6. If the assigned Teacher is unable to continue providing Classes, Marefati may arrange a replacement Independent Teacher or take another appropriate measure in accordance with the booking-modification and refund provisions. A Teacher change in these circumstances does not automatically cancel the Billing Cycle.
  7. Marefati may cancel a booking or suspend the Service where there is a material violation of these Terms, fraudulent or unauthorized use, a risk to the safety of the Student or other users, or a legal or regulatory requirement. The financial consequences of such action will be determined based on the reason for cancellation, the Services already provided, the refund provisions in these Terms, and applicable law.
  8. This section does not limit your right to request a remedy, re-performance of the Service, or a refund in the circumstances described in the Refund section or where the Service was not provided as agreed.

Refunds

  1. Amounts paid are not refundable because the Parent or Guardian changes their mind, the Student stops using the Platform, or the Student does not wish to complete the Billing Cycle. Refunds are limited to Affected Classes in the circumstances described in this section, subject to any other rights that cannot be excluded by law.
  2. The Parent or Guardian is eligible for a refund of the value of an Affected Class in either of the following circumstances:
  1. A Class is not considered affected for refund purposes if the inability to attend or complete it results from a cause attributable to the Parent or Guardian or the Student, including:
  1. Marefati will verify the reason the Class could not be provided using available attendance, joining, connection, and technical records. Marefati may request reasonable additional information from the Parent or Guardian to assist in verifying the issue.
  2. A refund is limited to the value of the Class or Classes shown to have been affected. It does not cancel the remaining appointments or entitle you to a refund of the entire Billing Cycle where the other Services were provided or remained available in accordance with the booking.
  3. Because the Service price is determined for a recurring weekly schedule throughout the Billing Cycle, the value of an Affected Class for refund purposes will be calculated proportionately by dividing the price allocated to the relevant weekly appointment by the number of Classes scheduled for that appointment during the Billing Cycle. This calculation is used only to determine the refund amount and does not change the pricing of the Service on a Billing Cycle basis.
  4. If an alternative Class is provided for an Affected Class, accepted by the Parent or Guardian, and is not affected by either circumstance described in paragraph 2 of this section, no additional refund will be due. If the value of the Class is refunded, the Parent or Guardian will not also be entitled to an alternative Class unless Marefati agrees otherwise.
  5. A refund request must be submitted through Marefati’s approved contact channel within forty-eight (48) hours after the scheduled time of the Affected Class. It is sufficient for the request to be submitted within that period, even if the review or payment processing is completed after the end of the Billing Cycle.
  6. The request must contain sufficient information to identify the Class and the problem, such as the date and time of the Class and a description of the issue. Failure to submit a request within the Billing Cycle does not waive any right that cannot be waived or restricted by law.
  7. Where a refund is approved, Marefati will return the amount due to the original payment method where possible. The amount may take additional time to appear, depending on the bank or payment service provider. Marefati does not control processing time after it has issued the refund.
  8. This section does not prevent Marefati from providing another appropriate remedy when a problem occurs, such as re-performing the Class or arranging an alternative Class, provided that this does not deprive the Parent or Guardian of rights available under law.

Booking Modifications

  1. During a Billing Cycle, the Parent or Guardian may modify one of the recurring weekly bookings in the Student’s schedule, subject to the options available on the Platform and this section.
  2. “Booking Modification” means changing one or more elements of a booking, including its day, time, subject, or assigned Teacher.
  3. The Parent or Guardian has a maximum allowance of three Booking Modifications during each Billing Cycle. Each confirmed modification uses one modification from that allowance.
  4. The modification allowance resets to three when a new Billing Cycle is purchased. Unused modifications do not carry over from one Billing Cycle to another.
  5. The modified booking applies to all remaining Classes associated with it until the end of the Billing Cycle.
  6. A Booking Modification is subject to the availability of a suitable day, time, subject, and Teacher. Marefati does not guarantee that a particular option requested by the Parent or Guardian will be available.
  7. A modification does not take effect, and is not deducted from the modification allowance, until an alternative is selected and the transaction is successfully confirmed through the Platform. The current booking remains in effect if no suitable alternative is available or the modification process is not completed.
  8. A Booking Modification may not be requested during the period beginning twelve hours before the next Class associated with the booking and continuing throughout the Class time until the end of its scheduled hour.
  9. If the booking to be modified is within the restricted period described above, the current booking remains valid. A modification may be requested after the Class ends and will then apply to the remaining Classes in the Billing Cycle.
  10. If the current Teacher is unable to continue, Marefati may arrange the appointment of another Independent Teacher for the same subject or propose an appropriate modification to the booking. If no alternative can be provided that allows the Service to continue, the refund provisions in these Terms will apply to the Affected Classes.

4. Rules of Use and Conduct

  1. You and the Student must use the Marefati Platform and Services only for lawful educational purposes and in accordance with these Terms and the instructions displayed within the Platform.
  2. You must appropriately supervise the Student’s use of the Platform, explain the rules of use and conduct in a manner appropriate to the Student’s age and ability to understand, and take reasonable steps to ensure compliance.
  3. You and the Student must treat Teachers and Marefati personnel respectfully and refrain from abusive or inappropriate conduct during Classes or through messages or other features available on the Platform.
  4. When using the Platform, participating in Classes, or communicating through it, neither you nor the Student may:
  1. The Student may not use a Class or messages to request Personal Information from a Teacher or another user, or share information that is not necessary for providing the educational Service, subject to the communication, privacy, and Student-safety provisions of these Terms.
  2. A Teacher may take reasonable steps to maintain the orderly conduct of a Class and protect participants, including warning the Student, restricting a means of participation, or ending the Student’s participation where there is serious misconduct or repeated disruption. The incident will be reviewed in accordance with Marefati’s approved procedures.
  3. Where Marefati reasonably suspects a violation, it may review the available records and information relating to the incident, request explanations from you or the relevant parties, and take action appropriate to the nature, seriousness, and frequency of the violation.
  4. Actions taken in response to a violation may include issuing a warning, removing violating content, restricting certain features, temporarily suspending the account, or terminating it in cases of serious or repeated violations. Immediate action may be taken where there is a risk to the safety of the Student or other users, or to Platform security.
  5. Marefati may report conduct to the competent authorities if reported or detected behavior may constitute a legal violation or create a risk to the Student, another child, or another user.
  6. Action taken against your account does not remove any financial rights available to you under law. The effect of suspension or termination on paid Services will be determined based on the reason for the action, the Services provided, and the cancellation and refund provisions of these Terms.

5. Privacy, Communication, and Student Safety

  1. The provisions of this section apply to you and the Student. You must explain them to the Student in a manner appropriate to the Student’s age and ability to understand and appropriately supervise the Student’s use of the Platform.
  2. You and the Student must use the communication methods available through Marefati only for educational and Service-related purposes and in a respectful and safe manner.
  3. You and the Student may not share Personal Information that is not necessary to provide the Service, including:
  1. The Student may not share the Student’s phone number, email address, or social-media accounts with a Teacher, or request the Teacher’s personal contact information, except through arrangements expressly approved by Marefati.
  2. You and the Student may not use the Platform to arrange Classes, communication, or direct payments with a Teacher outside Marefati where those Classes or that relationship originated through the Platform.
  3. You and the Student may not record or film Classes, take screenshots, copy messages, or publish or share any such material with third parties without the express consent of Marefati and the persons concerned, unless required by law.
  4. You and the Student may not publish a Teacher’s name, image, voice, messages, or any information relating to the Teacher or a Class on social media or any other website or service.
  5. The Student must inform you immediately if:
  1. You must notify Marefati as soon as possible of any concerning communication, inappropriate conduct, or suspicion that the Student has been harmed, and provide the available information that may assist Marefati in reviewing the incident.
  2. Marefati may restrict communication, preserve and review available information and records when a report is received or where there is a reasonable suspicion of a violation of these Terms or a risk to the Student, in accordance with the Privacy Policy and applicable law.
  3. You and the Student may not use the camera, microphone, or messages in a manner that violates another person’s privacy or exposes them to abuse, embarrassment, or harm.
  4. You are responsible for providing a suitable and safe place for the Student to participate in the Class and taking reasonable precautions to prevent other persons or private information from appearing unintentionally within camera or microphone range.
  5. The collection, use, retention, sharing, and deletion of your Personal Information and the Student’s Personal Information are governed by Marefati’s Privacy Policy, which forms part of these Terms.

6. Technical Use and Intellectual Property

  1. You and the Student may use the Marefati application, its content, and its features only for personal and educational purposes connected with the Service and in accordance with these Terms.
  2. All rights relating to the application, its design, software, logos, text, graphics, interfaces, features, and content provided by Marefati remain owned by Marefati or its licensors, as applicable.
  3. Use of the Platform does not grant you or the Student any ownership right in the application or its content. It grants you and the Student only a limited, non-exclusive, non-transferable right to use the Service while the account remains available, in accordance with these Terms.
  4. Neither you nor the Student, nor any person using your account, may:
  1. You and the Student may not attempt to access accounts, data, or areas of the Platform that have not been made available to either of you, or attempt to obtain permissions that you or the Student do not have.
  2. You and the Student may not bypass or disable any safeguard or control on the Platform, including the parental PIN, access restrictions, or identity or attendance verification systems.
  3. You and the Student may not:
  1. You and the Student may not circumvent an account suspension or restriction by creating another account, using another person’s account, or concealing the user’s or device’s identity.
  2. You and the Student may use materials provided by a Teacher during a Class only for the Student’s personal learning. Such materials may not be recorded, copied, distributed, published, or commercially exploited without the rights holder’s permission.
  3. If you or the Student sends a message, image, file, or other content through features available on the Platform, you or the Student must have the right to send it, and the content must not infringe another person’s intellectual-property, privacy, or other rights.
  4. Marefati may remove content sent by you or the Student, or restrict access to it, where Marefati reasonably suspects that it violates these Terms, the law, or another person’s rights.
  5. Marefati may restrict certain features or suspend or terminate your account in response to a technical violation or infringement of intellectual-property rights, depending on the nature, seriousness, and frequency of the violation, subject to rights that cannot be excluded by law.
  6. If you believe that content available through the Platform infringes your intellectual-property rights, you must notify Marefati through its approved contact channel, identify the content complained of and the right allegedly infringed, and provide the available information or evidence. Marefati may remove the content or restrict access to it while reviewing the complaint or after confirming the infringement.

7. Disclaimer of Warranties

  1. Marefati seeks to provide the Platform and Services in a safe and stable manner, but does not guarantee that they will be entirely free from interruptions or technical errors or that every feature will be available at all times.
  2. The Service may be affected by maintenance, services provided by technical third parties on which the Platform depends, or circumstances beyond Marefati’s reasonable control. You are also responsible for providing a suitable device, internet connection, and settings required to use the Service.
  3. Marefati does not guarantee that the Student will achieve a particular academic result, grade, or level of improvement. Educational outcomes depend, among other factors, on the Student’s attendance, participation, preparation, and individual ability.
  4. Marefati does not guarantee that the teaching style of every Teacher will match all personal preferences of you or the Student, while remaining responsible for administering the Service and addressing issues in accordance with these Terms.
  5. This section does not exclude Marefati’s responsibility for Services it is required to provide and does not limit your rights to a refund, re-performance of the Service, or any other right that cannot be excluded or restricted by law.

8. Disputes Between You and a Teacher

Disputes may arise between you and a Teacher relating to the Teacher’s actions, statements, or personal conduct. The parties concerned are responsible for resolving those disputes, and Marefati does not become a party to them merely because the parties were introduced or the Class was provided through the Platform.

Marefati may review a report relating to a Teacher and take appropriate action concerning the Teacher’s account or continued provision of Services. However, Marefati is not required to represent either party in the dispute or assume the Teacher’s personal obligations.

9. Governing Law and Dispute Resolution

  1. These Terms are governed by and interpreted in accordance with the laws in force in the United Arab Emirates.
  2. If a dispute arises between you and Marefati in connection with these Terms or the Services, the parties will first seek to resolve it amicably.
  3. If an amicable resolution cannot be reached, the competent courts of the Emirate of Abu Dhabi will have jurisdiction over the dispute, subject to any mandatory jurisdiction established by law.

10. General Provisions

  1. A delay by either party in exercising a right under these Terms does not constitute a waiver of that right.
  2. If any provision of these Terms becomes invalid or unenforceable, the validity of the remaining provisions will not be affected. The affected provision will be interpreted as closely as possible to its intended purpose and to the extent permitted by law.
  3. These Terms, together with the Privacy Policy and any policies referred to in them, constitute the agreement governing your and the Student’s use of the Marefati Platform and Services.
